Terms of Service
FitMito is a lifestyle and habit companion. It is not a medical device, does not diagnose, treat, cure or prevent any disease, and its AI coach is not a doctor, dietitian or therapist. Always consult a qualified healthcare professional before changing your diet, exercise, supplements or medication — especially if you have any medical condition, are pregnant, or take prescription drugs. If something feels wrong, stop and see a doctor. In an emergency, call your local emergency number.
1. Agreement to Terms
By creating an account or using FitMito (the "Service", available at fitmito.com), you agree to these Terms. If you don't agree, don't use the Service. You must be at least 16 years old.
2. Description of Service
FitMito turns healthy habits into a game: a daily quest, an AI coach you can chat with, a virtual companion ("Mito") that reflects your consistency, body-progress visualisations, optional wearable-data feeds, and small utilities the AI can build for you inside the app.
3. Use of Service
- Use it for your own personal, non-commercial health journey.
- Don't abuse, reverse-engineer, scrape, overload or attempt to break the Service or its AI budget limits.
- Don't upload unlawful content or other people's personal data without their consent.
- One person per account. You're responsible for activity under your login.
4. AI-Generated Content
Coach replies, plans, estimates (like calorie counts) and app panels are generated by AI. AI makes mistakes: numbers can be off, suggestions can be imperfect. Treat AI output as a helpful draft, not ground truth, and never as medical guidance (see the box above). You are responsible for what you do with it.
5. Self-Experiments (the Lab)
The Lab lets you design your own n-of-1 experiments — try a change, track it, read the result. The built-in safety framing (stop-rules, baseline periods, "no good evidence" verdicts, red-flag prompts to see a professional) is there to keep you sensible — it is not medical supervision. You run experiments on yourself at your own discretion and risk. Never test anything that requires medical oversight, never change or stop prescribed medication as an "experiment", and stop immediately and consult a professional if anything feels wrong (see the medical box above).
6. Your Content and License
Your logs, photos, measurements and chat messages stay yours. You grant us the limited license needed to store and process them so the Service can work for you (see the Privacy Policy for details). Our goal is not data farming — it's to legally and fairly help you live better. We don't sell your data, we don't let AI providers train on it, and we don't use your photos for anything other than showing your own progress back to you (they never leave your device). AI features run on fair-use budgets (daily caps per plan) to keep the Service sustainable and available to everyone.
7. Third-Party Services
FitMito uses trusted processors to function: Google (sign-in, AI models), Supabase (authentication), Vercel (hosting), GitHub (encrypted-at-rest data storage). Their terms apply to their parts. Wearable feeds (e.g. Apple Health exports) are optional and under your control.
8. Subscriptions & Payments
The Free plan is genuinely free. Pro is a paid subscription billed as shown at purchase. Prices may change with notice; changes never apply retroactively to an already-paid period. Promotional offers (seasonal campaigns, the 100%-club free month) are one-time, non-transferable and carry no cash value.
9. Right of Withdrawal (EU Consumers)
If you're an EU consumer, you have 14 days to withdraw from a paid subscription without giving a reason, unless you've expressly consented to immediate performance. Email hello@fitmito.com and we'll sort the refund for the unused period.
10. Intellectual Property
The Service — its design, code, characters (including Mito), and branding — belongs to us or our licensors. These Terms don't grant you any right to use the FitMito name or Mito outside the app.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available". We don't warrant it will be uninterrupted, error-free, or that any health outcome will be achieved. Progress projections are estimates, not promises.
12. Limitation of Liability
To the maximum extent permitted by law, our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months before the claim, and we are not liable for indirect, incidental or consequential damages. Nothing in these Terms limits liability that cannot be limited by law (including for gross negligence or intent).
13. Indemnification
You'll defend and hold us harmless from claims arising out of your misuse of the Service or violation of these Terms.
14. Suspension and Termination
You can stop using FitMito and delete your account anytime. We can suspend or terminate accounts that break these Terms, with notice where practicable. On termination you can request an export of your data (it's a plain-text repo — it was always yours).
15. Modifications to the Service and Terms
FitMito ships fast; features evolve. We may modify or discontinue features, and update these Terms. Material changes will be announced in-app or by email at least 14 days before they take effect. Continued use after that means acceptance.
16. Force Majeure
Neither party is liable for delays caused by events beyond reasonable control (outages of upstream providers, natural disasters, war, governmental acts).
17. Governing Law and Disputes
These Terms are governed by the laws of Romania. Disputes go to the competent courts of Bucharest, Romania — after we've both genuinely tried to fix it over email first. EU consumers retain any mandatory protections of their country of residence and may use the EU ODR platform.
